**Important Information**
A minimum of 72 hours notice is needed for all orders. Quotes will be emailed within 72 hours of request. No order will be added to the calendar or dates held without payment. Quotes are only valid for 48 hours. However, the only way to be guaranteed a place on my calendar is to pay a booking deposit as other quotes are continuously being emailed so your date may easily become booked in the meantime. Once you have made the first payment for your order it is considered accepted and confirmed. You are then considered to be agreeing to the Terms and Conditions as set out below and this then becomes a contract between yourself and Dragonfly Sweet Dreams. See separate section below for information on all Wedding Cake Orders. Quotes are only valid for 48 hours. However, the only way to be guaranteed to be placed on my calendar is to pay a booking deposit.
1. Delivery is available for all orders. Delivery within 20 miles of zip code 78626 is free. For orders over 20 miles delivery is $15 and up depending on distance travelled. You must inquire about delivery when ordering. Delivery is different for Weddings. See below.
2. For pickup orders, you will be advised of the collection location when your order is confirmed, and final payment is received. If you have not arrived by your given pickup time, a 30 min grace period is given. Beyond that, a late fee of $25 will then incur unless you have contacted me, and arrangements have been made for a different time. You will then have to contact me to arrange for a new pickup time. All orders not picked up within 24 hours of scheduled pickup time are considered void and no refund will be issued.
3. Full payment is required for all orders under $30. For orders above this, a 50% non-refundable deposit is required on all celebration orders. For all other orders the balance is due 5 days prior to delivery/collection or by the date stated on the invoice. Payment of your deposit acts as acceptance of these terms and conditions.
4. The deposit is non-refundable. In the event of cancellation by the customer, depending on the date of cancellation, the deposit may be held over towards another order. Dragonfly Sweet Dreams reserves the right to make the final decision on this. Orders are confirmed upon receipt of the deposit. If you fail to make the agreed upon payments, Dragonfly Sweet Dreams will cease work, the order will be cancelled, and no refund will be given. I will not purchase any items or start work on your order until a deposit is received. All goods remain the property of Dragonfly Sweet Dreams until full payment has been received. For all orders booked more than 1 month out, if not paid in full, price may fluctuate due to increase in market prices of ingredients and supplies.
5. If Dragonfly Sweet Dreams cancels your order due to unforeseen circumstances, your deposit will be refunded to you in full and I will do my best to find another baker for you.
6. Any changes to design or flavor must be made at least 2 weeks in advance. Requests to change design or flavor must be made in writing by email to info@dragonflysweetdreams.com
I reserve the right to make minor changes to design in order to maintain the integrity of the cake and the quality of the product.
7. I will not duplicate the design of another baker or cake decorator, nor will I create designs which are subject to copyright (including but not limited to Disney, Peppa Pig, Marvel etc). I will do my best to incorporate your chosen theme into a design which does not infringe copyright or duplicate another design. This may include the addition of licensed cake toppers or toys that will fit the requested theme which will be added to the cost of the order.
8. Orders can be collected on arrangement or delivered to your chosen address (a fee may apply). It is recommended that any cake 2 tiers or above are delivered to ensure that transportation is suitable and so that any minor imperfections can be fixed. All items picked up are the sole responsibility of the customer once it leaves the premises. No damages will be covered once it has left.
9. All cakes are stored in a cardboard box for ease of lifting and transport.
10. If you choose to collect your order, please ensure a safe place is available to store your order in your vehicle. Cakes should ideally be placed on a flat surface in the back floorboard. If this is not available, then the front passenger footwell is the best place for the cake. Cakes should not be placed on a seat or in a person's lap as this is not level or secure. Vehicle should be maintained with a cool temperature. Items should not be left in a vehicle that is not running as the integrity of the structure is at risk. Please see the "Care Instructions" on the Ordering Tab for more information.
11. If upon receipt of your order you are not 100% satisfied with the look of your items, you are NOT obligated to take the order. If you choose to refuse, you will be refunded 50% of the value unless the order is completely opposite of the design requested or not edible. Once an order is picked up by you or your designated party, it is considered accepted. Refunds requested due to sizing, decorating style, color, shade, or choice of general decoration design WILL NOT be honored. Refunds will only be considered on return of the products received and once inspected. Flavor and texture are subjective. Refunds requested due to flavor/texture after order has been accepted/picked up are only offered if the product is brought back to me and the quality of the flavor or texture is determined not to meet my standards. Quality determination is at my own discretion. Keep in mind variety in temperature and humidity may impact the flavor, overall design, or texture of the cake to some degree. Please understand I cannot control changes in texture or changes in color or shape due to weather conditions. Please note that refunds will not be given where the care instructions have not been followed.
12. I am not responsible for your order once it has been picked up. Nor am I responsible for damage once the order has been delivered or set up at the venue. I ensure that all cakes are structured and safe for travel and display. If care instructions have not been followed, I will not refund any amount. Please see the "Care Instructions" area on the Ordering Information Tab for more information. Dragonfly Sweet Dreams is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond bakery's control. If Dragonfly Sweet Dreams has completed the cake but it can’t be delivered due to uncontrollable circumstances, the Client will be refunded 75% of the total cost.
13. This does not affect your statutory rights.
14. Whilst I do my best to accommodate every order, and I offer allergy friendly baked goods, I understand the severity of allergies. I must inform you that I do use products (chocolate, flour, etc.) that may have been manufactured around nut products. I do my best to find ingredients listed that have not been processed in a nut facility. My desserts are made using shared equipment that also processes nuts and gluten. I do not have a dedicated allergen-free kitchen. I do a deep clean after every order. If there is a specialty dietary order, I will not accept any other orders on the day of production of said item to reduce the risk of cross contamination. You should notify your guests of the risk of possible allergic reactions. I am not responsible for any allergic reactions that may occur. Please advise of any allergies at the time of ordering. Please be aware that my kitchen is not a “Free From” kitchen and as such I cannot guarantee that any products are completely free from allergens. However, I do have procedures in place and will happily bake items which do not contain allergens.
15. If you would like floral decorations on your cake, please advise of this at the time of booking. I take every care to ensure that floral decorations are made food safe before being used on a cake. I do not accept any liability if you add any floral decoration to your cake that could cause harm. This also applies to any non-edible decorations. If flowers are provided by an outside source, we will place them for you. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants.
16. Where required I will use food safe supports including dowels and thick straws. When this has been done you will be given information on what supports have been used. These must be removed when cutting.
17. I reserve the right to use any photographs of my desserts for display or promotion without compensation to you, including presenting them on my Facebook page, Instagram page, and website.
18. Terms and conditions are updated regularly.
19. Performance of this agreement is contingent upon our ability to complete the Agreement and is subject to labor disputes or strikes, accidents, Acts of God, and other causes beyond our control.
**Additional Wedding Terms & Conditions**
1. For Wedding Cakes, collection is not available. Delivery and set up is calculated as part of your cost during the consultation.
2. For Weddings, a $50 non-refundable deposit is required to be placed on calendar. Then 60 days before wedding 50% is due with the balance required 30 days prior to the event. Payment of your deposit acts as acceptance of these terms and conditions. The date of the event is considered “booked” upon receipt of a non-refundable deposit. This deposit will be applied towards your final balance.
3. In the event of cancellation by the customer, depending on the date of cancellation, the deposit may be held over towards another order. Dragonfly Sweet Dreams reserves the right to make the final decision on this. For Weddings, if cancelled within 15 days of wedding date, only a 50% refund will be given minus any items purchased towards the wedding cake.

I will not purchase any items or start work on your order until a deposit is received. All goods remain the property of Dragonfly Sweet Dreams until full payment has been received.

For all weddings, changes will be accepted until 30 days prior to your wedding event. After this lockout date, no changes will be accepted. This is due to changes in the price of the cake as well as any preparation that has already begun. Dragonfly Sweet Dreams will follow the Client’s requests closely to create the cake desired, however I cannot duplicate an exact copy of another cake artist’s work but will ensure the look is as similar as possible.
6. If Dragonfly Sweet Dreams cancels your order due to unforeseen circumstances, your deposit will be refunded to you in full and I will do my best to find another baker for you.
7. Dragonfly Sweet Dreams is not responsible for bodily injury, property or consequential damage, which may result from services. Nor is it responsible for any damage to the cake or shortage of cake caused by anyone NOT employed by Dragonfly Sweet Dreams.
8. Dragonfly Sweet Dreams is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond bakery's control. If Dragonfly Sweet Dreams has completed the cake but it can’t be delivered due to uncontrollable circumstances, the Client will be refunded 75% of the total cost.
9. The Client must notify Dragonfly Sweet Dreams if there is a change in the date of the event or a complete cancellation. If the postponement occurs more than 30 days of the wedding, no penalty fee will be charged. If the postponement occurs 30 days or less prior to the date wedding, the Client will be charged a minimum $50 fee. If a cancellation occurs more than 30 days of the wedding, all money will be refunded minus the deposit fee and cost for any items that had already been purchased. If cancelled 30 days or less prior to the date of the wedding, only a 50% refund will be given minus any items purchased towards the wedding cake. If cancelled less than 15 days, no refund will be given.
10. There is a minimum delivery fee of $100.
11. Dragonfly Sweet Dreams is not responsible for tardiness if the venue is changed within 48 hours of the event.
12. The Client is responsible for providing a suitable environment for the cake (away from heaters, vibrations, people, suitable surface, suitable outdoor setting).
13. The Client or Client's representative must sign a waiver to ensure the condition of the cake is satisfactory prior to Dragonfly Sweet Dreams leaving. Once the waiver is signed, the bakery is not responsible for cake including collapse, melting, pokes etc.
